The Department of Homeland Security has delayed to December 31, 2021 the regulation that meant to replace the random, computerized H-1B lottery with a selection process based on the Department of Labor’s wage level system.
The new rule was scheduled to take effect on March 9, 2021. However, it has now been delayed and accordingly, this year’s H-1B cap lottery will be conducted in the same manner as last year - i.e., as per the random selection from both the regular and advanced degree online registration submissions.
USCIS is expected to announce the start and end dates this month for the upcoming online H-1B lottery registration period.
